Allegations of sexual abuse against Jose Menendez will be part of the argument that Erik and Lyle Menendez plan to make as they seek to be resentenced, said Los Angeles County District Attorney Nathan Hochman.

Los Angeles County District Attorney Nathan Hochman said the judge presiding over Erik and Lyle Menendez's resentencing case should consider "all evidence," both from their past prior to the crimes and their behavior behind bars since their sentencing.

Lyle and Erik Menendez have been serving sentences of life in prison without the possibility of parole for the1989 murder of their parents, Jose and Kitty Menendez. They still face a resentencing hearing March 20 and 21.

The District Attorney said he didn't believe the evidence met the rigorous or narrow standards to either vacate the conviction or give the brothers a retrial.
